The Ministry of Employment: Bill on Pay Transparency Submitted for Consultation

On 26 February 2026, the Danish Ministry of Employment submitted a bill to amend the Danish Equal Pay Act for public consultation.

The bill aims to implement the EU Pay Transparency Directive (EU 2023/970) and introduces significant new obligations for employers.

The proposed rules are intended to strengthen the principle of equal pay for men and women for the same work or work of equal value and includes, among other things, rules on:

  • pay transparency in recruitment processes
  • employees’ right to receive pay information broken down by gender for comparable positions
  • stricter requirements for objective pay criteria
  • enhanced documentation and enforcement obligations

The consultation deadline is 27 March 2026.

In the draft bill, the Government proposes that the new rules enter into force on 1 January 2027, which is later than the EU’s general implementation deadline of June 2026. However, the effective date may change during the legislative process.
